1. Introduction

1.1. The terms and conditions below detail our duties and your rights and apply to all interactions between Aristocracy London and the public. These interactions include, but are not limited to, any use of the Aristocracy London website and all product orders from it;

1.2 Please read through these terms and conditions carefully before using our website because, by doing so and/or engaging in any interaction with Aristocracy London, you agree to be bound by them;

1.3 We also encourage you to read our privacy policy, regarding how we collect, manage and use your personal information, and our cookies policy, which refers to which cookies we use and how;

1.4 By using our website and purchasing our products, you confirm that you are, at least, 16 years old;

2. Definitions

2.1 “We/Us/Our” means our company:

2.2 “Website” means aristocracy.london and any other URL operated by Us;

2.3 “Conditions” means the terms and conditions contained in this Website;

2.4 “You/Your” means the user of this Website and any of Our services;

2.5 “Product/s” means any goods that are listed on this Website and are available for purchase;

2.6 “Order” means any order placed by You via this Website for any of Our Products;

2.7 “Contract” means the contract which is put in place when You place an Order and We confirm that We accept the Order. Any such Contract is governed by the Conditions specified here.

2.8 “Personal Information” means any and all information provided by You when you use any part of Our Website, register for an account or place an Order. This personal information includes, but is not limited to, Your name, address and card details.

2.9 “U.K.” means the United Kingdom of England, Scotland, Wales and Northern Ireland;

2.10 “International” means countries other than the U.K.;

2.11 “Working Days” means Monday to Friday 9am to 5pm (U.K. Time). It, therefore, excludes bank, public and statutory holidays.

3. Orders

3.1 By clicking on the “CONFIRM ORDER” button, You accept that You are happy with all the details of Your Order. This includes, but is not limited to, the Product itself, its size and price;

3.2 When You place an Order, You are bound by the Conditions that apply at the time of placing the Order. Any changes subsequently made to Our Conditions do not apply retrospectively;

3.3 If You wish to modify or cancel Your Order, after You have clicked on the “CONFIRM ORDER” button, please contact Our customer experience team as soon as possible. Although We will make every effort to accommodate Your request, We are unable to accept change requests if you have requested any alterations or personalisation and We have begun actioning Your request. We may also be unable to accept change requests for other reasons including, but not limited to, stock availability e.g. if You ask for a different Product or size.

3.4 Your Order for Products is accepted and a Contract is formed between Us and You when We confirm your Order and not before. The confirmation of Your Order, which establishes a Contract between Us and You, will be sent to the email address that You provided Us with;

3.5 All Orders are subject to confirmation by Us and also subject to availability. As there is a delay between the time the Order is placed and the time it is confirmed, the stock position relating to particular Products may, in the meantime, change. If, indeed, a Product You have ordered becomes unavailable before We confirm Your Order, We shall inform You as soon as possible and offer You the option of a full refund or an Order amendment;

3.6 We reserve the right to refuse an Order. This may happen for a number of reasons, including but not limited to:

  • Stock availability;
  • Payment not being authorised;
  • Error being identified in any of the Product information contained on Our Website or any other communication by Us. This includes, but is not limited to, price and promotional offer details;
  • Suspicion of fraudulent activity;
  • Reasonable suspicion that there is intention to resell the Products;
  • Reasonable suspicion that the Order was made in bad faith, including but not limited to an intention to retain our Products so they’re not made available to other customers;
  • Violation of Our Conditions.

4. Product Information

4.1 We make every effort to ensure that the information on Our Website including, but not limited to, Product descriptions and prices, is correct and that photographic representations of Products are accurate. However, due to technical reasons beyond Our control, the appearance of colours on Your screen may not match how they look in reality. In order to help You make an informed choice, We will include the colour of Our Products in their description.

5. Price & Payment Options

5.1 The prices displayed on Our Website, or any other means of communication We use to advertise Our Products, only refer to the Products that are advertised for purchase, as per the Product descriptions. Unless stated otherwise, any items or accessories shown in photography and used for styling purposes are not included in the price of the Product;

5.2 Where We have made an error in the price of an item on Our Website, or any other means of communication We use to advertise Our Products, We reserve the right to withdraw this item from sale at this price and present it at the correct price. If You have placed an Order at the incorrect price, We will inform You of the error and give You the opportunity to confirm Your Order at the correct price or cancel and obtain a refund against the price You paid;

5.3 Prices on Our Website are displayed in British Pounds and We only accept payments in British Pounds;

5.4 Prices on Our Website are inclusive of all taxes (where applicable) at the current rates;

5.5 Prices are subject to change without notice. These changes will not affect Orders that have already been confirmed;

5.6 We accept a variety of payment methods. Specifically, we accept:

  • Mastercard;
  • Visa;
  • American Express;
  • Discover;
  • PayPal. Please see www.paypal.com for information on PayPal payments.
  • Cash (for in-store purchases);

5.7 All credit/debit cardholders are subject to validation checks and authorisation by their card issuer. We will notify You, at the check-out stage, if Your card issuer does not authorise payment. Please note that We will not accept Orders where the payment has not been authorised and We will not be liable if the payment is delayed;

5.8 Where payment has not been made in full, We may cancel Your Order and/or suspend any further deliveries to You;

5.9 We take all necessary measures to keep the details of Your order and payment secure;

5.10 We will not be responsible for fraudulent use of a lost or stolen credit or debit card on Our website. However, We will assist the authorities and/or Your credit/debit card company, to the best of Our ability, if We are asked to do so.

6. Delivery

6.1 Our delivery service is free of charge for Orders over £80;

6.2 We deliver to the U.K.;

6.3 We do not currently deliver to Jersey and Guernsey;

6.4 We do not currently deliver to the Republic of Ireland and other international destinations;

6.5 As per Our arrangement with Our external supplier of delivery services, We expect orders to be delivered within 2-5 Working Days. However, deliveries to Northern Ireland, the Isle of Man and the Highlands may take longer;

6.6 To track Your parcel, please use the tracking ID found in the dispatch confirmation email We will send You as soon as the Order is dispatched;

6.7 All items included within the same Order, will be dispatched in one shipment. However, in exceptional circumstances and due to e.g. stock and packaging requirements, We may need to ship products contained within the same Order in multiple packages and at different times;

6.8 You must provide Us with complete and accurate delivery information, to include both the correct address and the correct name for the recipient. We cannot be liable for delaying or failing to deliver Your Order as a result of You supplying Us with incomplete or inaccurate information;

6.9 We will use a third party or parties to deliver Our Products to You. This may be the Royal Mail or a courier company. These third parties may make deliveries on Saturday, as well as Working Days. We cannot be liable for any third party’s failure to deliver the Products to You;

6.10 In the event that the third party requires You to sign to acknowledge receipt of delivery, We are entitled to rely on any signature that may be given by You or any other person at the address the delivery is made to. In the case of signed delivery, the third party will make three attempts before returning the parcel to their facilities;

6.11 If you request that the parcel is delivered with no requirement that You sign for it, the driver may decide, if You are not at home, to leave the parcel in a secure place or with a neighbour and post a card advising You where they have left it. In the case of unsigned delivery, We cannot be liable if the delivery fails to reach You due to theft or any other reason;

6.12 While We make every effort to deliver Your Order within estimated timescales, there may be occasions where deliveries are delayed for reasons beyond Our control and We cannot be held liable for any delay which could not have been foreseen or avoided by Us.

6.13 If Your Order does not arrive within 7 Working Days and You have not had any communication from Us to advise of a delay please contact Us here to track a missing Order.

6.14 We only take responsibility for delivery fees within the U.K. and for Orders over £80. If You request delivery to a destination that incurs any additional costs, e.g. taxes, customs duties and any other form of import fees, You assume responsibility for these fees.

7. Returns & Refunds

7.1 You can request to return Products within 30 days from the date of purchase and We’ll offer a full refund or exchange, provided the Products and any complimentary (gift) items are returned in their original condition. Please note that, in case of a refund request, each returned parcel will incur a handling fee of £15.00, e.g. if You return 2 parcels using 2 separate labels, the total cost will be £30.00;

7.2 In order to request a refund or exchange, please submit an enquiry on the Contact Us page of Our Website, using the subject Returns & Refunds. In Your enquiry, please provide the full name under which the Order was placed, the Order number, exact items You wish to return, the reason for the return and, if requesting an exchange, the Products and sizes you wish to exchange with. When We receive Your request, We will send further information by email and You will then have 7 days to return the items;

7.3 When we receive the returned items and confirm they’re in their original condition, we’ll issue the refund within 14 Working Days from the date of receipt. The refund will be credited via the same method You used for payment. Please note it may then take 2-3 Working Days for the refund to show in Your account, depending on Your bank or card issuer’s processing times. If the debit/credit card that You used expires before We process Your refund, please contact Us here;

7.4 If We find that the returned Products aren’t in their original condition and/or if there are any items or labels missing, including any complimentaries/gifts, We reserve the right to refuse the refund or exchange request. To avoid disappointment, please make sure You’re happy with all items before removing the labels and do not wear fragrance, deodorant or make-up when You try on garments, to avoid leaving marks or scent; If We refuse the refund, We will give you the option of returning the items to You, in which case You will be charged for all associated costs, e.g. returns handing fee, courier delivery charges etc.;

7.5 Returned items are Your responsibility until they reach Our stores or warehouse so please ensure the packaging is secure and the items folded appropriately. If You can’t reuse the original packaging, please package the Products as best as You can and remember to include Your completed returns form inside the parcel;

7.6 Please retain Your proof of posting from the Drop Shop. In the unlikely event that We don’t receive Your return, this will be the proof required by Us to action Your return accordingly. We would recommend taking a picture of the receipt for safeguarding;

7.7 We cannot accept the return or exchange of goods that have been altered in any way, including but not limited to shortening the sleeves or trousers, changing the button thread, tapering, monogramming or engraving;

7.8 We would kindly ask that You try on shoes on a carpeted surface to avoid damaging the soles. Please note that if the soles appear scuffed or the shoes aren’t in their original condition We reserve the right to refuse Your refund or exchange request;

7.9 For hygiene reasons, socks, underwear and facemasks are non-returnable unless faulty.

7.10 Do not return items using a courier service other than the one recommended by Us or we will be unable to process the refund or exchange request;

7.11 Items that were ordered online or ordered in-store for home delivery cannot be returned in store;

7.12 Items that were bought and collected in one of Our stores will need to be returned to the same store;

7.13 Products returned because of a defect will be exchanged free of charge. In case the same Product isn’t available, We will offer You an exchange with a different Product or a full refund without applying the returns handling fee.

7.14 When the item You request to exchange and the item You exchange for are the same price, We will arrange dispatch of Your exchanged items within 5 working days from the day We receive the returned item, provided they satisfy Our returns policy;

7.15 When the item You request to exchange is priced higher than the item You exchange for, We will arrange for a refund of the difference in price and dispatch Your exchanged items within 5 working days from the day We receive the returned item, provided they satisfy Our returns policy;

7.16 When the item You request to exchange is priced lower than the item You exchange for, You will have to request a refund of Your initial Order and place a new Order;

7.17 If the Product You request to exchange for isn’t available in the required size, We may suggest an alternative product or offer a full refund. If you select the refund, Your exchange request will thereafter be treated as a refund request;

7.18 The returns handling fee of £15.00 per parcel doesn’t apply for exchanges.

7.19 We accept only one exchange request per Order.

7.20 If You receive the exchanged Product and decide to return it, the request will be managed as a regular refund request and You will have 30 days from the initial purchase to return the Product and not 30 days from the date the exchange request was placed;

8. Appointments

8.1 We don’t accept walk-ins. If You arrive to the showroom without an appointment, We reserve the right to refuse service although We may suggest a suitable appointment slot based on availability;

8.2 It is Your responsibility to provide the correct contact details when booking an appointment so We can contact You for reminders, queries or in case We need to cancel Your booking;

8.3 We reserve the right to cancel an appointment when We have grounds to believe the appointment was booked in bad faith, including but not limited to reserving multiple appointments slots and failing to attend previous appointments without notice;

8.4 We cannot take any responsibility if the Products or sizes You wish to try on aren’t available, including but not limited to any expenses incurred;

8.5 Although We make every effort to honour all appointment bookings, We may be forced to cancel for reasons beyond Our control. When this is the case, We will give as much notice as reasonably possible in the circumstances and We will not take responsibility for any expenses incurred by You in order to attend the appointment;

8.6 Your appointment will be cancelled if You’re more than 15 minutes late and fail to notify Us. Please note that the end time of Your appointment cannot be amended if You’re late;

8.7 The duration of each appointment is 1 hour, provided You arrive on time. Please note that if You arrive late for Your appointment, We cannot extend its duration and We reserve the right to terminate the appointment at its scheduled end time;

8.8 We reserve the right to terminate the appointment and refuse service when a customer is rude to Our staff, behaves inappropriately in any way or shows poor standards of personal hygiene;

8.9 Purchased items cannot be kept in Our showroom for more than 12 months.

9. Alterations

9.1 If You require alterations to the Product You purchase from Us, Our tailors will be happy to provide a quote. However, please note alterations aren’t included in the Product price and will be agreed to and charged separately;

9.2 Alterations may take up to 10 working days, subject to availability and depending on the amount of work required;

9.3 If You request alterations, You may need to attend additional fitting appointments and the exact schedule will need to be agreed with Our tailors. Please note it’s Your responsibility to ensure the schedule You agree to meets Your requirements, especially if You require the Product to be ready by a specific date;

9.4 If You request additional alterations beyond what you initially agreed to, these may incur additional costs and may delay completion;

9.5 Alterations are considered completed upon confirmation by You that You are happy to collect the Products or have them dispatched to You;

9.6 We do not accept return, refund or exchange requests for Products that have undergone any alterations by Our tailors or any other supplier;

9.7 We do not accept responsibility for alterations made by any company other than Aristocracy London Ltd.

10. Privacy Policy Statement

10.1 We are committed to protecting the personal data You entrust Us with. For details about what information We collect and how We use it, please see Our privacy policy;

10.2 By using Our Website, You consent to Our privacy policy and You confirm that all data provided by You is accurate and up to date. We therefore kindly ask You to regularly update Your account information for accuracy and consistency;

10.3 Please note that Our privacy policy does not affect or in any way limit Your rights under GDPR and the Data Protection Act 2018.

12. My Rewards

12.1 My Rewards is the Aristocracy London loyalty programme, whereby members collect points against future purchases from Our Website. This loyalty programme is open to any person aged 16 or over;

12.2 In order to join the My Rewards programme, You must set up an account on the Aristocracy London website and complete the validation process. Once the validation process is complete, We will award 1,000 points that will show in Your account;

12.3 As part of My Rewards by Aristocracy London, We will award You points based on purchases at Our Website. Specifically, We will award 2 points for every £1 that you spend on qualifying purchases, which are any transactions that are not excluded in these Conditions. You will not accrue points on purchases that are fully paid for by redeeming a promotional code (voucher) and offer, gift card or redemption of a reward (for example, My Rewards points). If You part-pay for a purchase by redeeming a promotional code (voucher) and offer, gift card or reward, You will only accrue points on the element of the purchase above the value of the promotional code (voucher) and offer, gift card or reward;

12.4 We reserve the right to either increase or decrease the number of points accrued or redeemed on qualifying purchases, or to change how points are accrued or redeemed, from time to time and at Our sole discretion;

12.5 We will offer a discount of £1 for every 100 points redeemed. In order to redeeem My Rewards points, a minimum order of £100 is required;

12.6 You can redeem Your discount by entering the amount of points in the My Rewards section at either the “cart” or “checkout” page. The discount cannot be applied after checkout has been completed so please check Your Order thoroughly before confirming to avoid disappointment;

12.7 You can redeem My Rewards points against gift cards;

12.8 Reward points can be used in conjunction with any other promotional offer and gift card when placing an Order;

12.9 We reserve the right to terminate membership where We believe, at Our sole discretion, that any member is misusing the programme. In this case, We reserve the right to refuse the issue of rewards and/or the redemption of points;

12.10 In the instance that fraudulent activity is suspected, We reserve the right to suspend Your account whilst further investigation is undertaken. If fraudulent activity is confirmed, We reserve the right to terminate membership and refuse the issue of rewards and/or the redemption of points;

12.11 You can check Your current points balance in the My Account section of Our Website. In most cases, any credited points will appear immediately but please allow up to 24 hours for Your points to be updated;

12.12 If We refund You for purchases that earned points, We will deduct these points from Your points balance;

12.13 If we refund You for purchases against which You redeemed points, We will credit the redeemed points back to Your account;

12.14 You cannot transfer points to another person, including members of Our loyalty programme;

12.15 Rewards may be redeemed partially or in full on transactions for online purchases only;

12.16 If You delete Your account or Your membership is cancelled for any reason, Your points will also be cancelled and no rewards, or any other financial or other benefit, will be issued in respect of them;

12.17 Aristocracy London will not be liable for any loss or damage resulting from termination of or changes to the programme or for the revocation of points and rewards;

12.18 Reward points cannot be exchanged for cash and have no expiry date.

13. Promotional Codes & Offers

13.1 Aristocracy London may make promotional offers, in the form of vouchers or codes, from time to time. These will remain valid until their expiry date, can only be used once and can only be used by the person for whom they were intended;

13.2 Promotional offers are only available for Orders which will be delivered within the area where We currently deliver;

13.3 Promotional codes (vouchers) cannot be used in conjunction with any other promotional offer but can be used in conjuction with My Rewards discounts and gift cards;

13.4 Promotional codes (vouchers) and offers will only be accepted if submitted at the point of Order and will not be applied retrospectively. Please check Your Order before clicking the confirmation button to avoid disappointment;

13.5 You can use promotional codes (vouchers) to cover part of the price of an item and either pay the remaining balance or use a gift card. In this case, do note that any subsequent refunds, if You choose to return the item, will be primarily to the gift card, if used, and subsequently to the part of the price that You paid for;

13.6 Promotional codes (vouchers) and offers cannot be exchanged for cash;

13.7 We may withdraw the promotional codes (vouchers) and offers at any time without notice.

14. Gift Cards

14.1 Aristocracy London Gift Cards can only be purchased through Our Website and can only be redeemed against Orders which will be delivered within the area where We currently deliver;

14.2 A gift card can be used as full or part payment. If the value of Your Order exceeds the credit on the gift card, the remaining balance must be covered using another payment method. If the value of Your Order is less that the credit on Your gift card, then the value of the Order will be deducted and the remaining balance on Your gift card can be redeemed against a future purchase before the expiry date of the gift card;

14.3 When You return or cancel an Aristocracy London Order and a gift card was used as part payment, the equivalent refund by way of gift card and money spent will be issued to You in that order;

14.4 A gift card cannot be exchanged for cash, used as credit or topped up; a gift card cannot be used to purchase a gift card;

14.5 Gift Cards will automatically expire 24 months from the date they were ordered and any remaining balance will be forfeited;

14.6 Gift cards can only be redeemed in the currency shown on the card;

14.7 Gift cards can be used in conjunction with other promotional offers;

14.8 We are not liable for lost, damaged or stolen cards;

14.9 Only one Gift Card can be used per transaction;

14.10 We reserve the right to refuse to accept gift cards suspected of being affected by fraudulent activity and/or unauthorised use.

15. Competitions

15.1 Aristocracy London may, from time to time, run competitions and prize draws. When We do, these will be announced together with the terms and conditions which will govern them.

16. Reviews

16.1 Reviews and written comments are generally posted within up to four Working Days from the day You submit them. However, We reserve the right to refuse to post or remove any submission for any reason and at Our sole discretion;

16.2 By submitting a review or comment for publication on Our Website, You acknowledge that You, not Aristocracy London, are responsible for the contents of Your submission;

16.3 By submitting any content to Aristocracy London, You represent and warrant that:

  • You are the sole author and have not copied the content from any third party;
  • All content that You post is accurate;
  • Use of the content You supply does not violate these Conditions and will not cause injury to any person or entity;

16.4 You further agree and warrant that You shall not submit any content:

  • That is known by You to be false, inaccurate or misleading;
  • That infringes any third party’s copyright, trademark, or privacy;
  • That is, or may reasonably be considered to be, defamatory, racially or religiously biased or offensive, contains obscene language, or is threatening or harassing to any individual, partnership or corporation;
  • That includes any information that references other websites, addresses, email addresses, contact information or phone numbers;
  • That contains any potentially damaging computer programs or files, including but not limited to computer viruses;

16.5 All content that You submit will be used at Our sole discretion. We reserve the right to edit or delete any content on Our Website, at Our discretion and as We see fit.

17. Liability

17.1 To the best of our knowledge, Products purchased from Us through Our Website are of satisfactory quality, suitable for the purpose for which they are intended and in conformity with the Contract We form with You;

17.2 Our liability for any losses You may suffer as a result of Us breaching a Contract is strictly limited to the price of the Products that You purchased;

17.3 Aristocracy London excludes all other expressed or implied terms, conditions, warranties, representations or endorsements with regards to any goods. Aristocracy London accepts no liability for any indirect or consequential loss or damage, or for any loss of profit, revenue or business (whether direct or indirect) arising from purchase of Products on Our Website, irrespective of how this loss or damage was caused and whether it was foreseeable;

17.4 To the fullest extent possible, and except for the warranty set out above, We disclaim any and all warranties of any kind (whether expressed or implied) in relation to the Products.

19. Linking to this Website

19.1 You may link to Our Website, provided You do so in a way that is legal, represents Us accurately and neither damages nor takes advantage of Our reputation. You must make clear, however, that this link does not imply association, approval or endorsement unless this has been previously agreed with Us;

19.2 We reserve the right to withdraw linking permission without notice if We believe these Conditions are not followed.

21. Force Majeure

21.1 We will not be liable for any delay or failure in fulfilling Our Orders or any other obligation towards You, if such a delay or failure is caused by events outside Our control, i.e. Force Majeure Events;

21.2 Events outside Our control (Force Majeure Events) include, but are not limited to, the following:

  • any form of industrial action;
  • any form of civil unrest, terrorist attack or threat of one, invasion, war or threat of war or preparation for one;
  • any form of natural disaster;
  • any disruption in public or private transport;
  • any disruption in public or private telecommunications networks;
  • restrictions of any form put in place by any government;

21.3 We will, of course, take all reasonable steps to fulfil Our obligations to You, despite the Force Majeure event, and look into any ways to minimise its impact.  However, Our obligations, as per Our Contract with You, are deemed suspended throughout the duration of a Force Majeure event and We will have an extension, during that time, to perform Our duties.

22. General

22.1 The above Conditions and any other notices elsewhere on Our Website represent the entire terms and conditions that apply during any and all interactions between You and Aristocracy London;

22.2 No additional terms or conditions requested by and communicated in any way by You will form part of the Contract whether accepted or not by an employee of Aristocracy London. No employee of Aristocracy London can alter the terms and conditions of a Contract between Us and You, whether or not they confirm this to You in any way;

22.3 This agreement and any Contract for the purchase of goods shall be construed in accordance with, and governed by, the laws of England and Wales. You agree, as We do, to submit to the exclusive jurisdiction of the English courts in the event of any dispute arising from Our terms and conditions. All contracts are concluded in English;

22.4 This information is supplied in English only and we will continue to communicate in this way during all interactions with You;

22.5 Times quoted in these Conditions are Greenwich Mean Time or British Summer Time (as applicable);

22.6 If You breach these Conditions and We take no action, We will still be entitled to use Our rights and remedies in any other situation where You breach these Conditions;

22.7 If any of these Conditions are found to be illegal, invalid or unenforceable, then these specific provisions shall be deemed to be severed from Our terms and conditions but this shall not affect the remaining provisions in any way;

22.8 Aristocracy London shall have the right, in Our absolute discretion at any time and without notice, to amend, remove or vary the service and/or any page of this Website; this includes the present Conditions;

22.9 All notices given by You to Us shall be to Our address as set out in these Conditions. All notices given by Us to You will be either uploaded on our Website or sent to the email or postal address You provided when You placed Your Order with Us. Notice will be considered properly served and received:

  • immediately, when posted on the Website;
  • 24 hours after an email is sent, as long as the email is sent to the email address that the addressee provided;
  • 3 days after the date of posting any letter, provided that the letter was properly addressed, stamped and placed in the post;

22.10 You agree to indemnify, defend and hold harmless Aristocracy London directors, officers, employees, consultants, agents and affiliates, from any and all third-party claims, liability, damages and/or costs (including but not limited to, legal fees) arising from Your use of this Website or Your breach of these Conditions;
